One of my friend is in the same situation and he has been told by his lawyer that he can get his part-time concurrent H1 Extn for 3 years based on fulltime concurrent H1 approved I-140.
He is going to apply the same soon.

This question is implying that the stay for the children to go to school in canada would only be a month or so, not more than six months - so does anyone know if there's a risk in messing up the green cards while the family waits a month in canada while waiting for the next destination.

Hello,
You can be a passive partner (investor) in any startup (even without any visa). To be an active partner, you need to be a permanent resident or citizen in US. Here is a link for the details... Hello,
Could anyone please suggest me a few consulting companies who can sponsor H1B visa? I am trying to bring my friend who is in India working for an automotive OEM. He was in Michigan for a while and he went back to India and it�s been almost more than 7 years since he left but now he wants to come back to Michigan.
If anyone knows any consultants in Michigan would be perfect since I already have a job lined up (verbally) through my contacts but I am not successful finding an employer who can sponsor H1B for him.

Do you get I-94 if you travel and entering US on AP--YES ?
If yes what is end date on I-94 and how you get extention of I-94 for that I-94 ?--You will be on AOS status after I-94 expires also you can still get H1 extension and obtain new I-94,continue renewing EAD/AP

Reminded me of an incident when I was a teenager, a budding cricketer and was a huge fan of Nike sports shoes. I would see these uncles with big paunches wearing Nike and would think that the world is unfair that people like me don't get to wear Nike while random uncles do. Completely random thought!!!!
The point being - the situation we are in, we hope that our plight should be a discussion point in every conversation that India and US ensue in. It crossed my mind a couple of times that we should have pushed for it. State of mind I guess.
Do you think anyone will even mention (hopefully get solutions) the eb backlogs to the President when he is touring India? Do you think anything good might come out of it for us?

The G325A form contain the below text.

My lawyer mentioned that it is A# number. At present we dont need to fill anything.
Is it true?

On 28 November 2008, "the United States" as defined for purposes of the Immigration & Nationality Act (INA) just got bigger, with the addition of the Commonwealth of the Northern Mariana Islands. Although there are probably wrinkles I have not yet read in the treaty, this essentially puts the CNMI on the same footing as Puerto Rico. Here's the cute part:
Because the CNMI will become part of the "United States" as defined by �101(a)(38) of the INA, "residence or presence in the CNMI before 28 November 2009 shall NOT be considered residence or physical presence within the USA for INA purposes. Thus, on 29 November 2009, all persons physically present in the CNMI are considered "to be present in the United States without inspection, by operation of law."
Will these PWIs (present without inspection) be eligible to adjust status? Unclear? Are they working "abroad" for purposes of L visas? Yes, as it turns out. One thing is clear: Legal Permanent Residents (so-called "green" card holders) who wish to base a naturalization application based on physical presence in the CNMI will NOT be able to do so for pre-29 November 2009 periods of time. Remember in a marriage case....it is a 2 step process...Initially they get a temporary Gc and then after 2 years they get a permanent GC. So, she needs to see which GC is she getting before making any decisions.
Also ask them to go for counselling....if they can reconcile...

I'd mentioned the Silicon Valley India Community Centers (http://indiacc.org/Default.aspx)here before. They are apparently large, well run and well funded.
They put us in their Feb 23 newsletter (http://app.e2ma.net/app/view:CampaignPublic/id:866.206866750/rid:9942a913fae5c7ff928f6dce7356fc38). They got the description a bit wrong (workers on temporary visas), but hey they put our link in there.
I'm also working on having IV appear at some of their other events in the near future.

From your post it is not clear if your 140 is already approved or pending.
Anyhow, assuming it is approved and he cancels, then an RFE is bound to come, it is best to file for AC21 with new employer, since RFE could also involve EVL with recent paystubs................. now since in your case even your new job is with a consulting company (do not know how big it is), you might get stuck with RFE too.

My lawer is a delay master & I believe one can file himself. Is there any experienced guy here ?
Do one has to file 485 EAD & AP together or one can file 485 first & can file EAD & AP later on ?
What are the big NO NO & traps / mistakes one should avoid ??

I got this email today from CRIS saying my I485 has been transferred to another office.
What does this mean?
I am worried since my PD is 2006 and Visas are not avaialble what is that they wantto do now?
I changed my employer after 2 years of getting the I 140 approval and EAD.

I am also waiting on the dates to open in December. The dates are not available on the internet as yet. I think they open the dates for 1 week every week .. so you can only book a month in advance.

I have read around here about some people sending in their applications earliert then the recommended 120 days and they all got receipts so don't anticipate any issues with that. As far as photo's are concerned you don't have to send any photos with your efiled Ead since you will be called for a finger printing and photo session but for AP you need to send pic's and don't forget to write your A# behind the photos. Hope this helps. Read the link below for more info on what you need to send for AP and for EAD you will get a list of doc's they require once you are done filing online.

Go Out of country, Get Visa Stamped and enter back on H1, They will give you new I-94
