my lawyer just wrote me they filed EB2 for me and told me this means my case will be audited because 'job requirements are not normal' according to DOL :(
That is, my employer is asking for a master's degree for the position and that they should not be asking for master's, but I was assured it would not be difficult to justify that the position requires master's. And this stupid process will take about 2 years on average. I want to screem

yes. it depends how u do it...in our case we were buying a house in a new subdivision. we had identfied the subdivision, the parcel (lot), the upgrades, everything.
if we didnt have a realtor, the builders agent would be both the seller and buyer agents, thereby earning potentially 7% (3.5%+3.5%) for doing nothing.
so we found a realtor and he was more than happy to take 1% and give us 2.5% in terms of upgrades.
If u r buying a second hand house (so to speak) u dont need to worry about that because the seller pays both the buyer and the seller's commission. all u have to pay is closing costs.

Your case is a lil different than mine cause you did your I140 first, got online receipt that was sent with your 485. I am assuming one week later, when you had your PERM hard copy, you sent that along with other docs for your I140. I think you will be fine. You did everything right for the I140 and 485 is dependent on 140.
Me though...my lawyer sent both 140/485 together in the mail, nothing done online. and no perm hard copy was included..just the online approval ETA form, signed by me/employer, along with screen shot af DOLETA approval.
I will definitely keep you updated. I think mine will take longer than most cause on top of everything my file was sent to nebraska instead of texas....so it had/needs to be transfered to texas (NY employer).
Keep updating and if you hear about others (i'm trying to stay in touch with others in similar position), let me know...

I have applied for renewal of H1b and H4 by premium processing on 10-Jan-2010 based on pending green card. I got an RFE for my H1b for which my employer replied on 10-Feb-2010. My H1b got approved where as my wifes H4 got rejected on 22-Feb-2010. Still waiting for denial letter from USCIS. My wifes I-94 got expired on 11-Feb-2010. So is she out of status since 11-Feb-2010. What are my options. Is it better to re-open (MTR) case or go to india and re apply for H4. how is this out of status going to affect her chances of getting renewd in India or her green card application. Any other ideas. Please help.

This is a great idea. My EB3 pending for almost a year now at NSC and cases at TSC are being cleared well with in the 6 month timeframe.
I really wish IV could take this as a top priority issue.

Unless you want to get ready for boilerplate RFEs on the 140 dont go for premium processing. They just issue RFEs to make sure that case is "processed".

and it was filed on may 20, 2003

Ask your attorney to draft the experience letter. It may not be copied toto but support letter should cover the main points in the draft.

Update: My case was approved today. I-140 , EB3 India PD - 03/24/2005, USCIS Recd: 05/25/2007 at NSC. Transferred to TSC in Aprl'08. Approval email: 08/14/08.
