I am in a weird situation. My wife has green card and my child is a US Citizen and she has a PIO Card (Indian Green Card). I was on H-4 till my wife got the green card - however, I have been told that the H-4 is invalid as soon as the primary applicant receives the green card. I have received my EAD Card and I have completed the FP. For whatever reason, the lawyer did not apply for I-131 till Oct 12, 2007. Now he says, it will take 90 days. What documents should I be carrying while traveling to India to travel on AP (if I ever get one). Any response will be highly appreciated. Please help.

You might have got classified as an Electrical Engineer by TWC, and likely Level 4 with 5 years experience as a requirement. If 5 years is really the requirement, and if you are an electrical engineer, or have an EE degree, TWC usually gives this designation. It is difficult to overcome this. Your friends who had lower prevailing wages must have been in different locations or had different occupations, or both. If your lawyer has lots of experience doing PERM, you can probably trust him.

My I-140 was sent on July, 28th to TSC. I did not yet receive any receipt number. How long does it take to get the receipt number once I-140 is applied?
I received my Receipt in 6 Days. Applied on 21th June and Receipt on 27th June. But still in process at Nebraska Service Center.

Hi all,
My h1 extension was denied recently even after 140 was approved and I filed for MTR...and am waiting for the receipt number...i am in my 5th year on h1b...and i did nor apply for 485 yet..
my employer/attorney also said i can be here for 180 days...
can i change my status to F1 - study visa during this period.
My h1b and i94 expired last month....april 13
what are the other options....
any leads will be helpful..

In that case, your L-1 is due to expire in September. Your employer can file an extension petition. Once approved, you will get a new form I-797 with a I-94 (valid for the extended period). The new I-94 will allow you to live in the US for that specific period. If you want to travel abroad, you have to get the new visa stamped on your passport.

I assume you are planning on working in Canada using visitor visa. This is not legal and if you want to do it anyway, immigration authorities would question your intent of travel every monday to friday, when you have a valid H-1B work permit in USA. I don't think you will get by this.
My cousin had a similar experience he worked in Canada for two months on visitor visa, Immigration authorities were tough on him when he was on his way back to USA, asking him how come he had such a big vacation in a calendar year and also various other tough questions.
My advice is to apply for work permit in Canada through your existing companies branches in Canada and then work in Canada as you have suggested.
Please don't follow my advice blindly, contact your Attorney and look at all the legal ramifications and then decide about your future course of action.

Recently my employer written a mail saying that he is closing the company and said to look for new employer.Previously i am working through a middle layer.When i found new employer he directly approached main vendor regarding contract.Now i am working without middle layer.Mean while middle layer hold my 45 days pay .The middle layer is not willing to pay.It is almost 8 months.I worked more than 20 months through middle layer.Can i get my money back?The middle man Threatening saying there is contract which you cannot go and it is breach.Can you please advise.

You need only AOS receipt, when you travel outside
So dont worry about EAD and AP receipts as you will get EAD Card and AP Doc directly to your address
So just ask AOS receipt saying you are planning for travel

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

A similar arrangement was entered into on July 1, 2009, implementing IAP at Madrid Barajas International Airport.
The purpose of the IAP is to allow specialized U.S. Customs and Border Protection (CBP) personnel posted in foreign airports to utilize current targeting and passenger analysis information and/or an assessment of passengers� documentation to identify high-risk persons bound for the U.S. and to make �no board� recommendations to carriers and host governments.
Secretary Napolitano believes that the IAP arrangements will enhance the capabilities of both the U.S. and foreign countries in which we have collaborated with to protect our immigration systems as well as the global aviation network from abuse by terrorists and transnational criminals.

I'm sorry to hear about your mom's situation.
Obtaining the green card doesn't mean your mom has to come here immediately. She can attend the interview and choose to come at a later point. I'm not too familiar with the appointment process/wait times etc but it seems like a lot of hassle to have to reapply.
Is postponement of the interview a choice?
I dont know how long ago you obtained your green card or citizenship but these days it's a loooooooooooooooooooooong wait for the elusive GC. So grab your chance when it comes.
That was my two cents.
