Raise has nothing to do with GC processing.Decision of Raise Limit is set by employer and promotion does comes with change in job description.Keep one thing in mind Corporations make profit out of everybody whether its customers or employees doesnt matter.Corporations exists to make profits.by the way do you work for non-profit organization ?? in that case things are a little different based on finanicial availability.

How employee can retain PD in case of I140 is approved and employee change jobs?

First, your friends father needs to find an employer who is willing to sponsor him for H1B and later for GC. Usually, all legitimate employers will have a host of immigration lawyers and counselors who will take care of things from that time onwards.
That said - now may not be the best time to try and find a job in US. Finding a H1B job (i.e. one that cant be filled locally) - is even more of a challange. I wish him best of luck.
If the person has relatives in US (is your "friend" a US citizen?) - then he may be able to "quickly" (1/2 years for immidiate relative, much more for others) immigrate using the family based immigration.

It's really unfortunate, but what's in that cartoon is the truth. The humor is for people who don't have to go through that flow-chart or the people who get out quick.

I am travelling to India and I have got AP. I also have an I-94 when I arrived last time to US. This is expired and I also have a I-94 with my last H1b (expires in June 2010). Now, I am working on EAD.
My question is which I-94 I need to return to the Airlines while boarding the flight?
Also, I am starting my flight from Cincinnati to Washington. From Washington I have a connection to Dubai and then to Chennai. Where should I submit my I-94?

This is my opinion only (not IV's).
My feeling is that the Iraq Accountability Act and other similar bills that will be flooding the Congress with the Democrats in majority should have a minimal impact if any on the CIR. First, the CIR whenever it is introduced will be referred to the Judiciary committees of the Senate and House for markup. After the Judiciary committee is done, then the modified version will come before the entire Senate and House for additional discussion, debate, amendments, etc. before going to a vote. Assuming the bills are passed by the Senate and House, they will have a conference to sort out the differences in the House and Senate bills and then this final version of the bill will be placed before the House and Senate for a final vote. Once, this vote takes place and the bill is passed, then it goes to the President for signature.
In a nutshell, the CIR will alongwith other bills be processed in a parallel manner. A lot is in the hands of the Senate Majority Leader (sen. Reid) and House Speaker (Rep. Pelosi) in when and how long they want to schedule a debate on any bill that has passed through committee and is ready for floor action.

Hotel News Now, a leading Global Hospitality publication, ran a two-part series about staffing challenges facing the U.S. hotel industry. I was honored to be interviewed by the publication and share my insights on the problems facing hospitality employer in these challenging times.
With the level of unemployment about 8.5 percent, why do hotels still need foreign workers? There are various reasons, from location to the attitudes of American workers. And changes in schedules and lifestyle have affected one of the former staples of summer work�students.
The situation is bad for staffing professionals in the industry, said Jacob Sapochnick, a San Diego, California-based lawyer whose practice is devoted to immigration law. �Even though they can hire local people, they can never rely on them for the full term,� he said. �If you have a large hotel, need 50 housekeepers and hire locally, the turnover is very high. They find a better job or one that pays more. When you have H-2B workers, they know they have them for 10 months. Their visa depends on them working at that hotel.�
The more turnover, the less likely the hotel will function properly, Sapochnick said.

Hi,
I have a 4.5 years BSEE degree with the following remarks in chronological order:
- Graduated in 1996 after 4.5 years at a non-US University
- 1996, worked 2 years in company A as an embedded software designer
- 1998, worked 6 years in a fortune 500 company as an embedded software engineer.
defended my thesis and got my BSEE diploma/certificate (a.k.a Titulo or Title in english)!!!!.
- 2005 - present, working with my current US employer under H1B.
Despite the fact that I worked as an engineer since 1996 with just the course completion certificate (in my country that�s the only document you need to start working as an Electrical Engineer but not so for other engineering or professional disciplines) the issue is that I defended my thesis in 2005 so I could obtain the official diploma which was a requirement for my H1 visa.
My current employer is planning on opening a new job position that would require a MS degree or BS+5 years progressive experience, in other words the so called EB2 job requirements. Do I qualify for that EB2 position?, Would the experience I have since 1996 count as progressive experience?, should I wait for an EB3 position instead?

Anything we can do to complain and bring attention to the EB3 processing delays at Nebraska service center?
As it was they were moving very slow and processing dates have been stuck in Jan 07 for past couple of months. Plus results show hardly any approvals this year so far especially for retrogressed countries.
To top it now a few people having spoken with nebraska are reporting that only 140's (EB3...this doesn't seem to apply to EB2 for some reason) with current priority dates are being processed. That they will only start processing again in May 08. Who's to say come May 08, they won't go back to square one and say "oh we're still processing jan 07 and we will only move a few days each month when it comes to processing dates"
Which would be fine if people weren't waiting, depending on the 140 approvals to a) keep their H1b status 2) go back on h1b status 3) change jobs.
I think this is totally unfair to do this to EB3 category. Why are they picking on EB3 category like this?

My wife recently returned from India and at port of entry, the officer incorrectly wrote the paroled until date as Jul 12, 2010 instead of Jul 12, 2011. The date is incorrect on both I-94 and AP.
Will this create any issues and how can this be corrected? Her status is AOS pending, she doesn't have a EAD or H-visa
My wife's AP is valid till Oct 12, 2010. I would appreciate any help

I did it for my wife. If your spouse plans to use H1B even after 6 years of its expiry, then having her own I-140 will help to get 3 year extensions

Another great design, but the text seems a bit off with the design. For the most part, in a stamp, the text should be the consistent, dull part. In my view, it doesn't look nice when italicized or stylized excessively.
