AILA: Has the issue been resolved as to how to complete item 10 on Form ETA 750B? As discussed, the item asks for either 10a or 10b to be completed, whichever is appropriate, not both. Please note that Consulate location has not been a required entry since 1990. The reason the question existed was that under the pre-1990 preference system, one could process under a non-preference category with an approved labor certification and no I-140 petition so the question was necessary on the ETA 750. Since 1990, the item should have been marked "N/A". Therefore, we suggest that the item is no longer relevant.

Don't be so harsh Kumar. This whole process is so troublesome and some times illogical, you get all kinds of doubts, especially when you are working with a short time line. (S)He did not mention getting a green card for them but going through medicals.

I-130 does play a role, when applying for visitors visa. but that doesnt disquialify anyone from getting visa. you have to show string ties to your country and provide enough evidence that you will come back. there are cases where they hv granted 10yrs multple visas !!
As long as you disclosed your sister's immigration intent in the paper work and sent the right paperwork, it shouldn't be a problem.

Not sure about the first question. SKIL bill will exempt any advanced degree from US or Advanced degree in STEM from outside + 3 Years. PACE, TALENT and the current CIR only exempt STEM Advanced degree + 3 Yrs
I am not totally sure. I recall reading one amendment where they mentioned 203(b) in conjunction with this - which means EB2 qualification.

As you can see in my profile, my I-140 is approved and i'm waiting to file for I-485. I just went through a position change within my company via the company lawyer. The way the lawyer explained to me was that he did file a new H1-B petition for the new job and also i did receive my I797-A action notice from USCIS.
The lawyer had to file a new petition (I-129) based upon my approved I-140 and the most importatn action during this process was to phrase the job description in a way that the new job description was more than 90 percent the same as the I-140.
Moreover, the thing i'm nervous about is that no AC-21 was filed in my case. The lawyer did mention that there is no need to file AC-21 as i have not reached into the I-485 stage and that AC-21 is only applicable after the fact that I-485 has been filed.
Hopefully, my experience clears a few things for your case. You can PM in case you want additional details.

I have got my I 485 rejectd when i filed during AUG 2007 due to Improper fees but we paid the correct fees.We refiled with saying "Improper Denials of I-485 " and double packed saying byboss mail room. We tryied more than 5 times always we got back saying PD is not current. Please advice me how to proceed on this.

Hi! I'm H1B holder and my company is willing to sponsor the green card. I'm coming from Eastern Europe (Moldova) and in US am working as software developer, I guess it's EB-3, right? I got approved H1-B notice on 30th Dec 2008 from CSC. My previous expired H1-B date ends with 02/14/2009, but my current newly approved one starts with 02/26/2009. So there is a gap of 11 days between those. Currently I'm on job. Does it really means out-of-status?. Do I need to run February pay check with less hours and officially in vacation?.

"This is becoming for high-tech companies a huge retention issue," Krumholtz said. "We will start to see highly valued tech employees emigrate back to their home countries."

I would like to know if i can file multiple 485s being primary on both ?
Here is my current status ...
1. Company A sponsored my GC and the priority is Oct'03 (never worked for this company)
2. Company B sponsored GC (priority Nov'05). - Currently working for this company
3. Both are EB-3
4. Applied 140 & 485 thru concurrent processing (Company A) in 2004
5. Now that all the dates are current, I am eligible to file 485 (Company B)
So my question is can i have two 485s filed ?
First case is future employment case but has '03 priority
Second case is more strong, but with '05 priority.
I am confused, what to do now.
Any advice is appreciated.
